These Terms & Conditions ("Terms") govern your access to and use of the Forme website, products, software, mobile and desktop applications, and related services (collectively, the "Service") operated by Forme Technologies LLC. ("Forme," "we," "our," or "us"). By creating an account, accessing, or using the Service in any manner, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to all of these Terms, you may not use the Service.

1. Eligibility and Account Registration

‍You may only use the Service if you are at least 13 years old (or the minimum age in your jurisdiction for online consent). If you are under 18, you may only use the Service under the supervision of a parent or guardian who accepts these Terms on your behalf.

To access certain features, you must register for an account. You agree to provide accurate, complete, and current information and keep it updated. You are responsible for all activity that occurs under your account. You must not share your password or credentials with others. Notify us immediately of any unauthorized use.

2. Scope of License

‍Subject to your compliance with these Terms, Forme grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for your personal or professional writing purposes.

You may not:

• Reverse-engineer, decompile, disassemble, or attempt to extract source code.
• Circumvent, disable, or interfere with security or content protection features.
• Use automated tools to access the Service (except public API integrations we authorize).
• Use the Service to violate laws or third-party rights.
• Frame or mirror any part of the Service without our consent.

3. Subscriptions, Fees, and Transactional Services

3.1 Subscription Plans

‍We offer multiple subscription tiers, including Free, Pro, and Premium. Paid plans may include monthly, annual, or custom billing cycles. Fees are disclosed at the time of purchase and are billed in advance.

Subscriptions renew automatically unless canceled at least 24 hours before the end of the billing period. You may manage your subscription from your account dashboard. Cancellation takes effect at the end of the current billing period.

We reserve the right to change pricing or features for any plan upon reasonable notice. Continued use after changes constitutes acceptance.

3.2 StoryShots™ and Transaction-Based Charges

‍Some features, such as StoryShots™, may incur one-time transactional fees. You will be clearly informed of such fees before confirming a transaction. All transaction fees are non-refundable once the service is rendered.

By using these services, you authorize us to charge your payment method accordingly.

3.3 Free Trials and Credits

‍We may offer promotional free trials or subscription credits. We reserve the right to change, limit, or revoke such offers at our discretion. Credits hold no cash value and may expire.

4. Payment and Billing Terms

‍We use third-party payment processors (e.g., Stripe, Paddle) to manage billing. You agree to provide valid, accurate billing information and authorize recurring charges until you cancel your subscription.

If your payment fails, we may attempt to reprocess or suspend access. If outstanding charges are not resolved promptly, we may terminate your account.

5. User Content and Intellectual Property

5.1 Ownership of Your Content

‍You retain full ownership of the original writing, documents, and other content you create or upload ("User Content").

You grant Forme a non-exclusive, worldwide, royalty-free license to host, display, process, and reproduce your User Content solely for the purpose of providing and improving the Service.

We do not claim ownership of your User Content.

5.2 AI-Generated Content

‍When using AI features such as StoryShots™ or StoryNotes™, you understand that:

• Output is based on your inputs/prompts and third-party models.
• Forme does not assert ownership over these outputs.
• We do not train our models using your User Content or proprietary libraries.

5.3 Content Rules and Restrictions

‍You represent that you own or have necessary rights to all content you upload and that it does not:

• Infringe third-party rights (copyright, trademark, privacy, etc.).
• Violate laws, contain libelous or offensive material.
• Contain harmful code, spam, or unauthorized advertising.

We reserve the right to remove content or suspend access if these terms are violated.

6. Export and Backup of Data

‍You may export your projects and content at any time using in-app export features. We encourage you to maintain backups of important work.

Upon deletion of your account, your content becomes immediately inaccessible and is permanently deleted within 30–60 days. We may retain anonymized or aggregate data for service improvement and analytics.

7. Service Availability and Modifications

‍The Service is provided "as is" and "as available." While we strive to offer reliable access, we make no guarantees regarding uptime, performance, or compatibility.

We reserve the right to:

• Modify or discontinue features without notice.
• Limit or suspend access due to maintenance, upgrades, or abuse.
• Reformat or remove inactive or obsolete content after extended periods of inactivity.

8. App Store Terms

‍If you download Forme from the Apple App Store or Google Play Store, you agree to the applicable store's terms and license requirements. Your license to the app is limited to a personal, non-transferable, non-sublicensable license for use on approved devices

9. Copyright and DMCA Policy

‍We respect intellectual property rights. If you believe content on Forme infringes your copyright, send a DMCA-compliant takedown notice to: legal@useforme.io

Your notice must include:

1. A description of the copyrighted work
2. The URL of the allegedly infringing content
3. Your contact info (name, address, phone, email)
4. A statement of good faith belief
5. A statement under penalty of perjury
6. Your physical or electronic signature

10. Indemnification

‍You agree to indemnify and hold harmless Forme, its affiliates, and their respective employees, directors, and agents from any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of:

• Your use of the Service
• Your violation of these Terms
• Your content or conduct on the Service

11. Limitation of Liability

‍TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORME SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF YOUR ACCESS TO OR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO FORME IN THE 12 MONTHS PRIOR TO THE CLAIM.

12. Termination and Account Deletion

‍You may terminate your account at any time in your account settings. Upon termination:

• Your access to the Service ends
• We delete your content within 30–60 days (except backups or legal retention)

We may suspend or terminate your account immediately for cause, including violation of these Terms, non-payment, or misuse.

13. Changes to These Terms

‍We may update these Terms from time to time. The latest version will always be available on our website with the "Last Updated" date.

If material changes occur, we will notify you via email or in-app notice. Continued use after such notice constitutes acceptance of the revised Terms.

14. Governing Law and Dispute Resolution

‍These Terms shall be governed by the laws of the State of Wyoming, without regard to its conflict of law principles.

Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in the United States of America, Wyoming.

15. Severability and Waiver

‍If any provision is held to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable. The remaining provisions remain in full effect. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.
