Terms Of Service

These Terms of Service ("Terms") govern your access to and use of the Forme website, web applications, products, software, and related services (collectively, the "Service") operated by Forme Technologies LLC ("Forme," "we," "our," or "us"). By creating an account, accessing, or using the Service in any manner, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to all of these Terms, you may not use the Service.

1. Eligibility and Account Registration

You must be at least 18 years old to use the Service. By creating an account or using the Service, you represent and warrant that you are at least 18 years of age. The Service is not directed to, and may not be used by, anyone under 18.

To access certain features, you must register for an account. You agree to provide accurate, complete, and current information and keep it updated. You are responsible for all activity that occurs under your account. You must not share your password or credentials with others. Notify us immediately of any unauthorized use.

You may maintain only one Free account. Free-tier features and allocations are intended for use by a single individual. You may not create or control multiple Free accounts, use additional or alternate email addresses or identities, or arrange for another person to create an account on your behalf, in order to obtain additional Free-tier features, allocations, trials, credits, or promotional benefits.

This restriction is directed at circumvention of Free-tier limits. It does not prevent separate individuals in the same household, workplace, or organization from maintaining their own accounts, and it does not restrict use of the Service by different people who share a network, device, or IP address.

2. Scope of License

Subject to your compliance with these Terms, Forme grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for your personal or professional writing purposes.

You may not:

• Reverse-engineer, decompile, disassemble, or attempt to extract source code.
• Circumvent, disable, or interfere with security or content protection features.
• Circumvent or attempt to circumvent any Free-tier limit, subscription-tier or AI usage limit, usage quota, account restriction, promotional limit, eligibility requirement, or any technical or administrative control we use to enforce them — including by creating or controlling multiple accounts, or by using multiple email addresses, identities, credentials, or payment methods, in order to evade an applicable restriction.
• Use automated tools to access the Service (except public API integrations we authorize).
• Use the Service to violate laws or third-party rights.
• Frame or mirror any part of the Service without our consent.

3. Subscriptions, Fees, and Transactional Services

3.1 Subscription Plans

We offer multiple subscription tiers, including Free, Pro, and Premium. Paid plans may include monthly, annual, or custom billing cycles. Fees are disclosed at the time of purchase and are billed in advance.

Subscriptions renew automatically until canceled. To cancel a paid subscription, send a cancellation request by email to support@useforme.io, which you can also reach from the Support page in the product navigation. Please send your request at least 24 hours before the end of your current billing period. Cancellation takes effect at the end of the billing period in which we process your request; if we receive your request after a renewal has already been charged, your subscription will remain active for that period and will not renew again.

You will continue to have access to your paid features until the end of the period for which you have paid.

We reserve the right to change pricing or features for any plan upon reasonable notice. Continued use after changes constitutes acceptance.

3.2 StoryShots™ and Transaction-Based Charges

Some features, such as StoryShots™, may incur one-time transactional fees. You will be clearly informed of such fees before confirming a transaction. All transaction fees are non-refundable once the service is rendered.

By using these services, you authorize us to charge your payment method accordingly.

3.3 Free Trials and Credits

We may offer promotional free trials or subscription credits. Trials, credits, and promotional offers are limited to one per person unless we state otherwise, and are void where obtained through multiple accounts or other circumvention of eligibility requirements. We reserve the right to change, limit, or revoke such offers at our discretion. Credits hold no cash value and may expire.

4. Payment and Billing Terms

4.1 Payment Processing

We use Stripe, a third-party payment processor, to manage billing. You agree to provide valid, accurate billing information and authorize recurring charges until you cancel your subscription.

If your payment fails, we may attempt to reprocess or suspend access. If outstanding charges are not resolved promptly, we may terminate your account.

4.2 Payment Disputes and Suspected Fraud

We may restrict, suspend, or terminate an account where we reasonably believe there has been:

• payment fraud;
• unauthorized use of a payment method;
• misrepresentation of your identity, your authorization to use a payment method, or your eligibility for a plan, trial, or promotional offer;
• abuse of the payment or dispute process; or
• use of paid features followed by conduct reasonably indicating that those features were obtained fraudulently.

Nothing in these Terms limits any right you may have under applicable law or under your card network's rules to dispute a charge. Raising a good-faith billing dispute is not a violation of these Terms, and we will not restrict or terminate your account for doing so. This Section applies to fraudulent or abusive conduct, not to legitimate disputes.

Where a payment is reported as fraudulent or unauthorized, we may suspend access to some or all of the affected account while we investigate. The purpose of a suspension under this Section is to secure the account, prevent further unauthorized charges, and prevent additional consumption of paid features while the status of the payment is unresolved. Where practical, we will contact you at the email address associated with the account, and we will not charge you for a subscription period during which access is suspended under this Section. If we determine that the payment was authorized, or that the dispute was raised in good faith, we will restore access.

Where a payment is reported as unauthorized, we may also cancel future recurring billing on the account as a precaution. Disputing an existing charge does not by itself cancel your subscription; to stop future billing, please cancel your subscription as described in Section 3.1.

5. User Content and Intellectual Property

5.1 Ownership of Your Content

You retain full ownership of the original writing, documents, and other content you create or upload ("User Content").

You grant Forme a non-exclusive, worldwide, royalty-free license to host, display, process, and reproduce your User Content solely for the purpose of providing and improving the Service. This license does not include the right to use your User Content to train artificial intelligence models, and we do not use your User Content for that purpose.

We do not claim ownership of your User Content.

5.2 AI-Generated Content

When you use AI-powered features such as StoryNotes™, StoryDecks™, or StoryShots™, your inputs are processed by third-party AI providers to generate output ("AI Output"). To the extent Forme holds any rights in AI Output generated from your inputs, Forme assigns those rights to you. Forme does not train AI models on your User Content or your AI Output.

AI Output is intended to serve as raw creative material — drafts, feedback, and visual concepts that you develop into finished work. Because generative AI draws on shared underlying models, you acknowledge that AI Output may be similar to output generated for other users, and that purely AI-generated material, standing alone, may not be eligible for copyright protection in some jurisdictions. The creative choices you bring — your premise, structure, voice, edits, selection, and arrangement — are what transform AI Output into original work that is distinctly yours and protectable as described in Section 5.1.

5.3 AI Output Disclaimer

AI Output is generated automatically and may contain inaccuracies, errors, or content that does not reflect your intent. AI Output does not constitute professional, legal, financial, or industry advice, and Forme makes no representation or guarantee regarding the quality, accuracy, originality, or commercial outcome of any AI Output, including feedback provided through script coverage or story analysis features. You are solely responsible for reviewing, editing, and verifying AI Output before relying on it or using it in your work.

5.4 Content Rules and Restrictions

You represent that you own or have necessary rights to all content you upload and that it does not:

• Infringe third-party rights (copyright, trademark, privacy, etc.).
• Violate laws, contain libelous or offensive material.
• Contain harmful code, spam, or unauthorized advertising.

We reserve the right to remove content or suspend access if these terms are violated.

6. Export and Backup of Data

You may export your projects and content at any time using in-app export features. We encourage you to maintain backups of important work.

Upon deletion of your account, your content becomes immediately inaccessible and is permanently deleted within 30–60 days. We may retain anonymized or aggregate data for service improvement and analytics.

7. Service Availability and Modifications

The Service is provided "as is" and "as available." While we strive to offer reliable access, we make no guarantees regarding uptime, performance, or compatibility.

We reserve the right to:

• Modify or discontinue features without notice.
• Limit or suspend access due to maintenance, upgrades, or abuse.
• Reformat or remove inactive or obsolete content after extended periods of inactivity.

8. Platform and Browser Support

Forme is a responsive web application accessible through supported web browsers on desktop, tablet, and mobile devices. Forme does not offer native iOS or Android applications.

The Service is optimized for Google Chrome and Apple Safari. Certain features are designed for specific environments: StoryDeck™ design capabilities are built for desktop-first workflows and are supported only in Google Chrome, while StoryDeck™ Preview is supported in Chrome and Safari across all devices. Feature availability and performance may vary by device, browser, and operating system, and we do not guarantee that all features will function identically across all environments.

9. Copyright and DMCA Policy

We respect intellectual property rights and respond to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA).

9.1 Takedown Notices

If you believe content on Forme infringes your copyright, send a DMCA-compliant takedown notice to legal@useforme.io. Your notice must include:

1. A description of the copyrighted work
2. The URL of the allegedly infringing content
3. Your contact info (name, address, phone, email)
4. A statement of good faith belief
5. A statement under penalty of perjury
6. Your physical or electronic signature

9.2 Counter-Notices

If you believe your content was removed by mistake or misidentification, you may submit a counter-notice to legal@useforme.io that includes:

1. Identification of the removed content and its former location
2. A statement under penalty of perjury that you have a good faith belief the content was removed as a result of mistake or misidentification
3. Your name, address, and phone number
4. A statement that you consent to the jurisdiction of the federal courts for the judicial district in which you reside (or, if outside the United States, the federal courts of Wyoming), and that you will accept service of process from the person who filed the original takedown notice
5. Your physical or electronic signature

If we receive a valid counter-notice, we may restore the removed content within 10–14 business days unless the original complainant notifies us that they have filed a court action seeking to restrain the allegedly infringing activity.

9.3 Repeat Infringers

We will terminate, in appropriate circumstances, the accounts of users who are determined to be repeat infringers.

10. Indemnification

You agree to indemnify and hold harmless Forme, its affiliates, and their respective employees, directors, and agents from any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of:

• Your use of the Service
• Your violation of these Terms
• Your content or conduct on the Service

11. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. FORME DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY AI OUTPUT WILL BE ACCURATE, RELIABLE, ORIGINAL, OR SUITABLE FOR ANY PARTICULAR PURPOSE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORME SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF YOUR ACCESS TO OR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE AMOUNT PAID BY YOU TO FORME IN THE 12 MONTHS PRIOR TO THE CLAIM.

13. Termination and Account Deletion

You may request deletion of your account at any time by emailing support@useforme.io, which you can reach from the Support page in the product navigation. Deleting your account is separate from canceling a paid subscription; to stop recurring billing, follow the cancellation process described in Section 3.1. Upon termination:

• Your access to the Service ends
• We delete your content within 30–60 days (except backups or legal retention)

We may restrict, suspend, or terminate your account immediately for cause, including violation of these Terms, non-payment, or misuse of the Service. Misuse includes abuse of account creation, subscription benefits, AI allowances, credits, trials, or other limited resources, and circumvention of the limits described in Sections 1, 2, and 3.

Where we reasonably determine that an account has been used for conduct described in this Section or in Section 4.2, we may also restrict, suspend, or terminate other accounts that we reasonably believe are controlled by the same person and used for the same purpose, and we may decline to provide further service where we reasonably determine that continued service presents a fraud, abuse, security, or payment risk. If your account is suspended or terminated on these grounds, you may not create a replacement account in order to circumvent that action without our written consent.

We will apply this Section proportionately to the conduct involved. If you believe your account has been restricted, suspended, or terminated in error, contact us at support@useforme.io and we will review the decision.

14. Changes to These Terms

We may update these Terms from time to time. The latest version will always be available on our website with the "Last Updated" date.

If material changes occur, we will notify you via email or in-app notice. Continued use after such notice constitutes acceptance of the revised Terms.

15. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Wyoming, without regard to its conflict of law principles.

Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Sheridan County, Wyoming, and you consent to the personal jurisdiction of those courts.

16. Severability and Waiver

If any provision is held to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable. The remaining provisions remain in full effect. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.
